Terms and Conditions

1. You agree to allow Pegasusnews.com and its successors and assigns (collectively, “the Site”) to make your music available to the public on the Site, including, without limitation, any music or video file(s) uploaded by you to the Site or any tracks contained on a CD that you send to us (“Content”).  For this purpose, Content shall also include band/artist pictures and album art.  You agree that we may post Content for download on the Site, host Content on our servers, and stream Content on the Site.  
    
   Where available, the posting and broadcast of Content will be accompanied by the corresponding album art, band/artist website URL, or other information on how to learn more about you or your music.
      
2. We cannot guarantee that we will make your Content available on the Site. We also reserve the right to restrict, suspend or remove your Content at any time for any reason without prior notice to you or liability to us.  
      
3. We agree not to sell or otherwise profit directly from the use of your Content. Advertising on the Site is not considered profiting directly from your Content. You understand you will receive no compensation or financial remuneration for the free artist listings provided by the Site.
      
4. We will remove any of your Content upon your request.  You may contact us at texasgigs@pegasusnews.com with any requests regarding your Content.
      
5. You retain all copyrights, public performance rights and other rights associated with your Content.  By submitting Content, you represent and warrant that:

• You have full right and power to enter into and comply with these Terms and Conditions, and have secured any and all third-party consents, licenses and permissions necessary to enter into and comply with these Terms and Conditions.
       
• The Content that you submit to the Site does not contain illegal samples of any third party's copyrighted work and will not infringe on any third party's copyright, patent, trademark, trade secret or other proprietary rights, rights of publicity or privacy.
       
• The Content that you submit does not and will not violate any law, statute, ordinance or regulation.
       
• The Content that you submit is not and will not be defamatory, trade libelous, pornographic or obscene.
       
• You are at least eighteen years of age.

You assume all liability for copyright infringement (for example, excessive sampling), defamation or other laws broken by the Content.  PLEASE DO NOT SUBMIT SUCH CONTENT!  You will protect us and hold us harmless if you breach any of these Terms and Conditions.
